Bob Aalberts (Accounting) coauthored an article, "Our Own Private Sustainable Community: Are Green Covenants, Conditions, and Restrictions a Viable Alternative to a More Environmentally Sustainable Future for Homeowners?" which was published in the spring issue of the New Mexico Law Review. His coauthor, Darren Prum of Florida State University, is a former student and lecturer in UNLV's Lee Business School. The article traces the history of private land use from the common law of England to the present day. It then discusses the now-promising application of green building standards for creating environmentally sustainable homeowners associations now occurring in various parts of the United States. It also applies the laws of common ownership, with an emphasis on restriction covenants, to conclude that this kind of sustainable environment can be done legally but with great care in how the restrictive covenants are worded and applied.
