SPECIAL SESSIONS WRAP-UP

The 82nd Legislative Session officially ended without the passage of bills related to capital improvement projects or baseball stadium funding. Consequently, the Governor called two Special Sessions – the 34th Special Session and the 35th special session.

The 34^th Special Session focused on the capital improvement program for the 2024-2025 biennium, introduced in AB1, and was ultimately passed by the Assembly and Senate.

The 35^th Special Session focused on SB1, to fund a baseball stadium in Clark County. SB1 was ultimately passed by the Assembly and Senate, as follows:

• A total of $380 million in public funding which includes:
  • $180 million in transferable tax credits
  • $120 million in county bonds
  • $25 million infrastructure credit from Clark County
• Required community benefits agreement (CBA) which must include:
  • Workforce diversity and living wage requirements
  • Active engagement by the baseball team and its players in the community
  • The use of a “community suite” by charitable and community organizations, educational programming with local colleges and universities (including scholarships and internships)
  • Annual financial commitment of at least $2 million or 1% of ticket revenue, whichever is greater
  • $5 million transmitted annually to a Clark County community housing fund

82^ND SESSION OF THE NEVADA LEGISLATURE  WRAP-UP

The 82nd Session of the Nevada Legislature officially adjourned sine die on June 06, 2023, and resulted in 536 pieces of legislation signed into law, and 75 bills ultimately being vetoed by the Governor.

During the 82nd legislative session, NSHE and UNLV were at the forefront of numerous policy proposals and funding initiatives. This includes more than $18 million in General Fund allocations to restore budgets reduced during the 2021 Legislative Session. Additionally, $14 million was approved to boost stipends for graduate assistants at UNLV, and $320,000 was allocated to bolster the K-12 teacher pipeline through enhanced summer school funding. The outcomes of several bills of interest to UNLV are listed below.

UNLV Bills of Interest Passed:

• Assembly Bill 140: Makes “Juneteenth Day” a legal holiday in Nevada to be celebrated on June 19 (if the date falls on a weekend, the holiday will be celebrated the previous Friday or following Monday). 
• Assembly Bill 268: Awards state employee retention payments of $500 for Classified and Professional staff in permanent positions at 50 percent or greater on March 31, 2023, and June 16, 2023 (this applies to staff who make less than $120,000 annually).
• Assembly Bill 328: Makes an appropriation to the Thomas & Mack Legal Clinic at the William S. Boyd School of Law 
• Assembly Bill 522: Provides a cost-of-living salary increase for state employees.
• Senate Bill 291: Supports the Nevada Institute on Teaching and Educator Prep within the College of Education ($1.5 million).
• Senate Bill 341: An appropriation bill that funds a tourism safety and research initiative through the Greenspun College of Urban Affairs and the International Gaming Institute’s Expanding the Leaderverse initiative.
• Senate Bill 350: Establishes the Graduate Medical Education Grant Program.
• Senate Bill 375: Creates a grant program to expand undergraduate and graduate nursing programs at UNLV and other NSHE institutions.
• Senate Bill 457: Expands student enrollment and supporting faculty at the Kirk Kerkorian School of Medicine ($9.2 million).

UNLV Bills of Interest Failed:

• Assembly Bill 74: This bill would have authorized the Board of Regents to enter into an agreement with a public or private entity, whether for profit or not for profit, to promote and enhance an educational program or student life at an institution within the System.
• Assembly Bill 224: This bill would have authorized professional employees to organize, form, join and assist professional organizations and engage in collective bargaining.
• Assembly Bill 265: This bill would have created a statewide mental health consortium to represent all regional mental health consortia established by existing law.
• Assembly Bill 382: This bill will would have made an additional appropriation to help expand the Thomas & Mack Legal Clinic.
• Assembly Bill 498: This bill would have provided additional retirement contribution for PERS and non-PERS employees.
• Senate Bill 297: This bill would have authorized the UNLV School of Medicine and the UNR School of Medicine to establish the Nevada Memory Network, which is a system for the diagnosis of dementia and the ongoing management of care for patients with dementia.
• Senate Bill 440: This bill would have provided a salary increase for state law enforcement including NSHE police.
• Senate Bill 496: This bill would have provided an increase in film tax credits which would allow up to $190M in tax credits per year over the next 20 years.

Update: Week 18 – Ending June 5, 2023

The 82 Session of the Nevada Legislature officially adjourned sine die on June 06, 2023, at 12:19am. While many outcomes are subject to change, below is a summary of where things were at the close of Session:

While the regular Session came to an end yesterday, the Governor has indicated his intent to call a Special Session in order to address items that were not resolved prior to the legislative deadline mandated by Nevada law. Note, UNLV’s advocacy efforts will not end with the end of the Session; we look forward to continuing our work with our local, state, and federal elected officials to further advance higher education initiatives on an ongoing basis.

The sixteenth week of the 82nd Session of the Nevada Legislature ended with 10 days left in the regular session. With so few days remaining and a deadline of Second House Passage this week on May 26th, there were very few committee meetings scheduled. The meetings were replaced with longer Senate and Assembly Floor sessions to meet their Friday deadline to move all remaining non-exempt  bills out of the second house. Additionally, the budget bills to fund the state were introduced this week.

The fifteenth week of the 82nd Session of the Nevada Legislature ended with 17 days left in the session. Legislators were busy meeting the May 19th deadline of Second House Committee Passage which means all bills, unless deemed exempt due to fiscal implications, must be voted out of committee to advance to the floor for full vote of the house. They were also focused on resolving budget differences to meet their May 20th budget deadline. Thereafter, the next major deadline will be May 26th for Second House Passage.

Update: Week 14 – Ending May 12, 2023

While Rebels continued to engage in the legislative process in Carson City during the fourteenth week of the 82nd Session of the Nevada Legislature, they were also busy on campus preparing for more than 3,500 students to officially become UNLV graduates on May 12^th and 13^th!

On the legislative front, the week ended with just 25 days left in the Session. This week, legislators began the process of resolving budget differences to meet their May 20^th deadline, and to prepare for the Second House Committee Passage deadline. Update: Week 13 – Ending May 5, 2023

The thirteenth week of the 82nd Session of the Nevada Legislature ended with the Economic Forum and many Senate Finance and Assembly Ways and Means Committee hearings to discuss the State budget. • 9:30 am - Economic Forum met to determine the state's fiscal outlook and funding available for the foundation of the state's budget. They reported Nevada projections will include $201 million more than previously projected for the upcoming FY23-25 budget, and an extra $50 million in surplus revenue for the current fiscal year ending in June. This is in addition to the historic $11.4 billion budget submitted by Governor Lombardo. Gaming and sales tax revenues are the primary sources for the additional funds.

The committee’s decisions are sent to full committees of Assembly Ways and Means and Senate Finance, and then to each house for vote. The committee moved to restore the budget reductions from the 2021 Legislative session ($52 million). Other decision points are as follows:
  • Increase in Weighted Student Credit Hours - The committee chose to suspend the funding formula distribution and allocate General Fund appropriations to each of the instructional institutions using the traditional base, maintenance, and enhancement decision unit model, and calculate the performance funding amounts.
  • Higher Education Funding Formula Caseload, Small Institution Factor, Research Space, and Performance Funding Pool Components for Instructional Budgets - The Subcommittee moved to approve the reduction of General Fund appropriations by $15.6 million in each year of the 2023-25 biennium resulting from a decrease in weighted student credit hours through the caseload adjustments.
  • Research Space and Operations - The Subcommittee approved the General Fund appropriations totaling $10.1 million in each fiscal year of the 2023-25 biennium to fund research space operations and maintenance funding for UNLV and UNR.
  • Performance Funding Pool - The Subcommittee approved the continuing existing policy to set aside 20% of the GF appropriations for the performance funding pool and allow Fiscal staff requests authority to make technical adjustments. They also included FY 2024 performance funding in each institution’s General Fund appropriation.
  • NSHE State Supported Budgets - The Subcommittee approved $37.4 million in General Fund appropriations across all NSHE state-supported budgets in each year of the 2023-25 biennium to restore budget reductions approved during the 2021 Legislative Session.
  • Graduate Assistant Positions & Stipends- The Subcommittee recommended approval of $20 million in General Fund appropriations over the 2023-25 biennium for UNLV ($14M) UNR ($6M).
  • Summer Teacher Education Programs - The Subcommittee recommended approval of $1.0 million in General Fund appropriations in each fiscal year of the 2023-25 biennium for support of summer teacher education programs at UNR, UNLV, CSN, GBC and NSC.
  • Student Derived non-General Fund - The Subcommittee approved revenues for the seven formula instructional institutions, four professional schools, and the Prison Education budget, as recommended by the Governor.
  • The  UNLV budget decisions are as follows:
    • Restoration of Budget Cuts, $18M - Approved and recommended by subcommittee
    • Graduate Teaching Assistant Funding, $14M - Approved and recommended by the subcommittee

Update: Week 11 – Ending April 21, 2023

The eleventh week of the 82nd Session of the Nevada Legislature ended with fewer bills for the Legislature to consider. In fact, nearly 239 bills and resolutions failed to meet the required first committee passage deadline; leaving 698 bills eligible for the legislative process.  To view a list of failed bills, please click here. 

Additionally, 117 bills and resolutions were declared exempt from deadlines, which would allow them to continue in the legislative bill process.  To view a list of exempt bills, please click here. 

The next major deadline for the Nevada Legislature will be April 25th, which is the First House Passage deadline where bills need to be voted out of the first house of origin to move to the second house.

The eighth week of the 82nd Session of the Nevada Legislature was full of excitement as the Legislature celebrated UNLV Day and Latino Lobby Day. Rebels were actively engaged with the legislative process this week. Notable activity included:

• UNLV College of Fine Arts Day at the Legislature - College of Fine Arts Dean Nancy Usher, UNLV Professor David Rowe, and UNLV Art Student McKenzie Easter met with Assemblywoman Tracy Brown-May, Assemblywoman Michelle Gorelow, Assemblywoman Shea Backus, Senator Dina Neal, and Senate Pete Goicoechea to advocate for planning and design funding to support a new College of Fine Arts building.  
• Joint Meeting of the Senate Committee on Finance and the Assembly Committee on Ways and Means - Presentation regarding the Governor’s recommendations for Statewide Inflation, Enterprise Information Technology Services rates, Attorney General cost allocation, other internal service fund rates, changes to fringe benefit rates, employee compensation cost of living adjustments (COLA), and additional salary increases for certain employee classifications for the 2024-2025 biennium.

• UNLV Day at the Legislature – Over 25 campus, Alumni Association, and Alumni Advocacy Committee leaders spent the day meeting with UNLV alumni legislators and state leaders, including Chief of Staff Ben Kieckhefer, Lt. Governor Stavros Anthony, and Treasurer Zach Conine. It was a powerful day of advocacy, punctuated by the UNLV Honors Jazz Quintet providing live music throughout the day.

Update: Week 6 – Ending March 17, 2023

This week provided a lot of excitement, both at the Nevada Legislature and at home on the UNLV campus! The 2023 Legislative Session marked the 40th day of the 120-Day Calendar on March 17^th, leaving 80-days remaining in the regular Session. At home, Rebels were honored to host the 46^th President of the United States, Joe Biden, on Wednesday.

• UNLV was honored to host President Joe Biden on our campus showing the world UNLV is the place to be! During his visit, President Biden met with health sciences students and members of the on- and off-campus community to discuss his plan to lower health care and prescription drug costs.This was the fifth visit from a sitting president in UNLV’s history.

Update: Week 5 – Ending March 10, 2023

The end of week 5 at the 82nd Legislature marked day 33 or approximately one fourth of the 120-Day Calendar, with 87 days remaining in the regular Legislative Session.  In honor of International Women’s Day, celebrated on March 8th, note the following statistics related to Nevada’s Legislature:

• Nevada is one of only two states with a female-majority legislature
• 60-percent of Nevada’s 63 legislators are women
• Nevada elected its first female state legislator in 1919
• In 2019, Nevada became the first state to have a majority of female legislators
• In 2021, the female-majority in the Nevada Legislature grew, from 52-percent to 60-percent
• Nationally, women made up 31-percent of total state legislators in 2021
• 12 of Nevada’s women legislators in the 82^nd Session are UNLV alumna

Update: Week 4 - Ending March 3, 2023

It was an exciting week for Rebels at the 82nd Legislative Session despite the legislature being closed for two days due to inclement weather. Rebels making it happen during the fourth week of the session included UNLV Student Day on March 3rd. Vice Provost for Graduate Education and Dean of the Graduate College Alyssa Crittendon, along with student leaders from GPSA and CSUN, had a very impactful day of advocacy.

Dr. Shawn Gerstenberger, Dean of the UNLV School of Public Health, and Megan Comlossy from UNR School of Public Health, provided overviews of their schools before the Senate Health and Human Services Committee

Vegas Chamber Day at the Legislature Higher Education Panel – Dr. Constance Brooks joined her counterparts from Nevada State College, the College of Southern Nevada, and the Desert Research Institute to discuss their respective legislative priorities with members of the Las Vegas Chamber during the Chamber’s Legislative Day at the Capitol

Alyssa Crittendon, Vice Provost for Graduate Education and Dean of the Graduate College, and more than 65 Consolidated Students of the University of Nevada, Las Vegas (CSUN) and Graduate & Professional Student Association (GPSA) leaders and students arrived in Reno to prepare for CSUN and GPSA Day at the Legislature on Friday.

In the morning, UNLV students took a tour of the Nevada Capitol and legislative buildings, and attended the Government Affairs Committee hearing to provide public comment on issues significant to UNLV students

GSPA President Nicole Thomas provided public comment to the Assembly Committee on Government Affairs, indicating Rebels’ support for investments in higher education, in teachers, and in working class Nevadans. She also shared UNLV students’ support for several bills, including AB69 (Expands the loan repayment program administered by the Nevada Health Service Corps to include certain providers of behavioral health care), AB161 (Revises provisions governing drivers' licenses), AB140 (Makes Juneteenth Day a legal holiday in this State), AB74 (Revises provisions relating to higher education), and AB118 (Revises provisions relating to the Nevada System of Higher Education). She closed her comments by letting our legislators know that UNLV students care, are paying attention, and want to be active partners.

Update: Week 3 – Ending February 24, 2023

It was another busy week at the 82^nd Session of the Nevada Legislature with week three coming to an early close due to inclement weather.

Over the third week of the session, Rebels continued to be engaged in the legislative process and to advocate for UNLV. This engagement included:

President Whitfield and Dr. Constance Brooks met with members of the Higher Education Subcommittee in preparation for the NSHE Budget hearing.

On Tuesday, the NSHE Budget Hearing took place. Dr. Constance Brooks, Jean Vock, and President Whitfield attended the hearing in Carson City, and Dean Marc Kahn attended from the Grant Sawyer building in Las Vegas.

On Wednesday, UNLV’s Vice President of Economic Development Dr. Bo Bernhard testified about the impacts Knowledge Fund projects have on Nevadans at the Joint Meeting of the Senate Committee on Finance and Assembly Committee on Ways and Means.

Thursday was Public Health Day at the Legislature. Dean Marc Kahn and students from the Kirk Kerkorian School of Medicine joined their counterparts from the UNR School of Medicine, Dean Paul J. Hauptman and students, for meetings with legislators. Later in the day, UNLV medical students were introduced on the Senate Floor by Senator Fabian Doñate. Dean Kahn also provided testimony regarding AB74 to the Assembly Committee on Education, and later joined the UNR School of Medicine Dean to give a joint presentation to the Senate Health and Human Services Committee relative to SB146. Kirk Kerkorian School of Medicine Students, Vishvaas Ravikumar (Internal Medicine) and Daphne Ferrer (Psychiatry), also provided testimony at the hearing.

Friday was very quiet in Carson City due to the inclement weather. However, Rebels continued to engage in Southern Nevada at UNLV’s Administrative Faculty Day. Tamara Marino, Education and Information Officer, provided Rebel Advocacy Training to assist the campus community with their legislative advocacy and engagement, and to review UNLV’s legislative priorities.

Update: Week 2 - Ending February 17, 2023

The second week of the 82^nd Session of the Nevada Legislature ends today with 363 Bills introduced, (186 Assembly Bills and 177 Senate Bills).

Rebels were actively engaged with the legislative process this week. Notable activity this week included:

• Chancellor Erquiaga presented the State of the System to the Assembly Education Committee and President Whitfield was called on to discuss college affordability and its impact on completion rates.
• NSHE had its Capital Improvement Project hearing where deferred maintenance projects and a chiller for DRI were discussed.
• In recognition of Black History Month, AB140 making Juneteenth a state holiday was heard. President Whitfield and Boyd Law externs Taylor Duffy and TJ Milk testified in support.
• On Mental Health Day, where many bills germane to this topic were heard, KKSOM Dean Kahn and Dr. Brooks testified in support of AB69 which allows for the expansion of the Health Service Corps loan forgiveness program to include mental and behavioral health practitioners.

February 6, 2023

The 82nd (2023) Session of the Nevada Legislature begins today. Higher education will be the topic of many discussions among Governor Joe Lombardo, Nevada legislators, and other stakeholders.

In his ‘State of the State’ address last month, Governor Lombardo shared budget priorities for the biennium, which include restoring higher education funding to pre-pandemic levels, investing in the welfare of our graduate students and research capacity by committing $20 million to support graduate assistants at Nevada’s research universities, and $9 million to expand student capacity and faculty at the Kirk Kerkorian School of Medicine. We’re very thankful to the governor for including these shared priorities in his proposed budget – and for his proposed investment in salary increases for the state’s workforce – and we look forward to working with him and other lawmakers to advance these initiatives during the session.

Additionally, UNLV will be working to make adjustments to the Weighted Student Credit Hours model to account for periodic inflation, advance support for summer education programs for future teachers, and secure funding for capital projects, including a new Interdisciplinary Science and Technology Building and a new Fine Arts Building.

UNLV will have an ongoing presence in Carson City throughout the Legislative Session. Dr. Constance Brooks will serve as the interim vice president of government and community engagement and will be UNLV's primary representative during the session, communicating our official positions on proposed or existing legislation. Dr. Brooks is well versed with the Nevada State Legislature, having served in roles in the private and public sector, including as the former government affairs representative for the Nevada System of Higher Education (NSHE). Dr. Brooks and the Office of Government and Community Engagement will work with our colleagues across NSHE, the president’s cabinet, and deans to ensure we have a consistent message and that our experts are available to address the legislature.

If you engage in such advocacy, you are required to do so from your personal email address, use personal stationery for hard copy letters, and indicate that you are advocating on your behalf (not on behalf of UNLV or NSHE).
